Sahih Muslim Shareef Main Divorce ka Bayan " with Urdu English translation

     مسلم شریف  طلاق کا بیان

حائضہ عورت کو اس کی رضا مندی کے بغیر طلاق دنیے کی حرمت اور اگر کوئی طلاق دے دے تو طلاق واقع نہ ہوئی اور مرد کو رجوع کرنے کا حکم دینے کے بیان میں

حَدَّثَنَا يَحْيَی بْنُ يَحْيَی وَقُتَيْبَةُ وَابْنُ رُمْحٍ وَاللَّفْظُ لِيَحْيَی قَالَ قُتَيْبَةُ حَدَّثَنَا لَيْثٌ وَقَالَ الْآخَرَانِ أَخْبَرَنَا اللَّيْثُ بْنُ سَعْدٍ عَنْ نَافِعٍ عَنْ عَبْدِ اللَّهِ أَنَّهُ طَلَّقَ امْرَأَةً لَهُ وَهِيَ حَائِضٌ تَطْلِيقَةً وَاحِدَةً فَأَمَرَهُ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يُرَاجِعَهَا ثُمَّ يُمْسِکَهَا حَتَّی تَطْهُرَ ثُمَّ تَحِيضَ عِنْدَهُ حَيْضَةً أُخْرَی ثُمَّ يُمْهِلَهَا حَتَّی تَطْهُرَ مِنْ حَيْضَتِهَا فَإِنْ أَرَادَ أَنْ يُطَلِّقَهَا فَلْيُطَلِّقْهَا حِينَ تَطْهُرُ مِنْ قَبْلِ أَنْ يُجَامِعَهَا فَتِلْکَ الْعِدَّةُ الَّتِي أَمَرَ اللَّهُ أَنْ يُطَلَّقَ لَهَا النِّسَائُ وَزَادَ ابْنُ رُمْحٍ فِي رِوَايَتِهِ وَکَانَ عَبْدُ اللَّهِ إِذَا سُئِلَ عَنْ ذَلِکَ قَالَ لِأَحَدِهِمْ أَمَّا أَنْتَ طَلَّقْتَ امْرَأَتَکَ مَرَّةً أَوْ مَرَّتَيْنِ فَإِنَّ رَسُولَ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ أَمَرَنِي بِهَذَا وَإِنْ کُنْتَ طَلَّقْتَهَا ثَلَاثًا فَقَدْ حَرُمَتْ عَلَيْکَ حَتَّی تَنْکِحَ زَوْجًا غَيْرَکَ وَعَصَيْتَ اللَّهَ فِيمَا أَمَرَکَ مِنْ طَلَاقِ امْرَأَتِکَ قَالَ مُسْلِم جَوَّدَ اللَّيْثُ فِي قَوْلِهِ تَطْلِيقَةً وَاحِدَةً

Abdullah (b. 'Umar) reported that he divorced a wife of his with the pronouncement of one divorce during the period of menstruation. Allah's Messenger (may peace be upon him) commanded him to take her back and keep her until she was purified, and then she entered the period of menses in his (house) for the second time. And he should wait until she was purified of her menses. And then if he would decide to divorce her, he should do so when she was purified before having a sexual intercourse with her; for that was the 'Idda which Allah had commanded for the divorce of women. Ibn Rumh in his narration made this addition: When 'Abdullah was asked about it, he said to one of them: If you have divorced your wife with one pronouncement or two (then you can take her back), for Allah's Messenger (may peace be upon him) commanded me to do it; but if you have divorced her with three pronouncements, then she is forbidden for you until she married another husband, and you disobeyed Allah in regard to the divorce of your wife what HE had commanded you. (Muslim said: The word "one divorce" used by Laith is good.)

یحیی بن یحیی، قتیبہ بن سعید، ابن رمح، قتیبہ، لیث، لیث بن سعد، نافع، حضرت عبداللہ سے روایت ہے کہ انہوں نے اپنی بیوی کو حالت حیض میں طلاق دی ایک طلاق۔ رسول اللہ صلی اللہ علیہ وسلم نے انہیں رجوع کرنے کا حکم دیا پھر وہ اس سے رکے رہے یہاں تک کہ وہ پاک ہوگئی پھر انہی کے پاس حیض آیا دوسرا حیض پھر اسے چھوڑے رکھا یہاں تک کہ وہ پاک ہوگئی اپنے حیض سے۔ پس اگر وہ اسے طلاق دینے کا ارادہ کرتے تو اسے طلاق دیتے جب وہ پاک ہوئی جماع کرنے سے پہلے۔ پس یہ وہ عدت ہے جس کا اللہ نے حکم دیا ہے ان کیلئے جن عورتوں کو طلاق دی گئی ہو اور ابن رمح نے اپنی روایت میں یہ اضافہ کیا ہے کہ عبداللہ سے جب اس بارے میں پوچھا جاتا تو فرماتے کہ اگر تو نے اپنی بیوی کو ایک یا دو مرتبہ طلاق دی تھی۔ (توتم رجوع کرسکتے ہو) کیونکہ رسول اللہ صلی اللہ علیہ نے مجھے یہی حکم دیا تھا یا اگر تو نے تین طلاقیں دیں تو تجھ پر حرام ہوگئی۔ یہاں تک کہ تیرے علاوہ دوسرے خاوند سے نکاح کرے اور تو نے اللہ کی نافرمانی کی جو اس نے تجھے تیری بیوی کی طلاق کے متعلق حکم دیا ۔ امام مسلم رحمہ اللہ نے کہالیث اپنے قول تطلیقة واحدة میں زیادہ مضبوط ہے۔
